I think the mods were very reluctant to ban me, I worked with a few of them back on RDF and I think there's still a bit of respect for the forum admin. Also, if it had been aimed at anyone else other than Timonen, it may indeed have received a sterner punishment, which kind of confirms the point I'm making. The fact that Timonen is not a normal member and should be treated differently is already implicitly accepted while being explicitly denied. That's the problem with those who are too wrapped up in the idea of rationalism, they are often blind to the implicit elements of human experience.

My opinion, as expressed a couple of days ago at RDF MarkII.

Looking at the document filed by the lawyer acting on behalf of the plaintiffs, a couple of points make me fear that RDFSR and Dawkins will not find this court case as easy to win as it should be. The first two items read "Breach of oral contract" and "Breach of the implied covenant of good faith and fair dealing".

The old saying that a verbal contract is not worth the paper it is written on is an exaggeration, but there is a kernel of truth in it.

What I wonder though Seraph is whether by acceptance of contracting fees JT has not explicity accepted/formalised the contract. I'm no legal expert, but coupled with the statements mentioned in the document as being caused by JT referencing the allocation of funds, this stands to reason I think. Given the burden of proof in a civil action, they might well have legs.

One big problem (this relates to the second point) is Timonen's ownership of the company that did a lot of the work in relation to the foundation's online retail outlet. He is alleged to have ripped off 92% of the profit. Timonen will undoubtedly argue that the withdrawals of moneys that he made are justifiable, notwithstanding the fact that those moneys were in addition to the fees and salaries he and his partner were getting. That, and the lack of a written contract will make it difficult to ascertain from a legal point of view, just how much - if any of those amounts - were excessive to the point of fraudulence. Terms of oral contracts are notorious for being disputed and so are implied covenants. The result will depend on the skill of the lawyers and on what kind of judge will finish up adjudicating the case even more so than if contracts and agreements were formally documented.

The only thing that has changed in the meantime is that I am now even less optimistic of Timonen being found guilty. Do you want me to tell you what I think of his behaviour from a moral point of view? Didn't think so.
