I doubt it's pragmatic, although I could be wrong. I doubt many in the legal profession have ever given much thought to the philosophies of materialism and determinism.

The assumption is that humans have an ability to control their actions via their own agency, and are held responsible for that.

We can't know whether we really have free will, or whether we are merely automatons who have a delusion of free will. However, if we assume that nobody is responsible for their own actions, then ordering society through laws is profoundly unjust. Of course, it's only unjust if we consider that we have free will the first place.... if all of us are automatons, then the idea that we have free will -- the false belief in it - is part of the determined course of action.

If we don't have free will then we don't have a choice about having a legal system. Or lawyers. Jesus, think of that, lawyers as an inherent manifestation of universal reality. Wow, this place sucks.

The image was from the "Demonstration" scene in Clockwork Orange.
The legal system took away Little Alex's fuck/fight agency via the Ludeveko Treatment, to determine "favorable" outcomes for itself and society. This is what deterrence would look like in rEvo's deterministic legal system, one with no base assumption of "free will" (aka: "personal agency" or "volition").
