The terms 'legal' and 'illegal' are completely malleable as far as he's concerned. If it's something he likes, of course it's legal (the US Supreme Court, stacked with his toadies, has essentially agreed with him) and as a corollary, he gets to decide if something is illegal as well. Toddlers tend to get what they want because they simply make a nuisance of themselves until they do.
Elon Musk is a toddler, to be sure: intellectually and emotionally. He isn't nearly as smart as he thinks he is or nearly as talented (at least in the ways he wants to be seen as talented). When you're a hundred-billionaire, no one will call you an emotional toddler; you're "eccentric."
But he's also a bully and a con man. He'll con you from the position of an unearned reputation, generally taking money and credit for other people's work and promising to share it with you if you just buy into the scheme. If that doesn't work, he'll bully you from a position of unearned wealth. Wealth buys you a political office which you can then control. Wealth buys you a bot-riddled media platform from which you can marshal your minions to destroy other people.
He's very good at gaming financial and corporate systems, a trait altogether common in West Coast business and politics. That takes some seed money, but mostly it takes a lot of bluff, bluster, and bullying. With patience, you can work your way up that ladder without actually being good at anything else.
