As the photographer, I own the copyright of the image by default, and therefore all profits proceeding therefrom. There was never any transfer of copyright. I told her I was taking a photo, and to pose nicely and fold her paws. She didn't resist. Consent for the use of the image must be presumed. Anything else said is lies and slander.

I heard you and the cat had an oral contract whereby you were taking the image as a work for hire.

And, I heard you prefer your contracts to both oral, and binding. :biggrin:

I honestly can't believe she'd betray me like this after all those years of shovelling shit and running the bath tap for her. I thought we had a straightforward understanding whereby I exploited her and took advantage of her boundless trust in me, in return for token gestures of affection and a couple of treats of expensive cat food here and there. Well, yes, as part of that inherent lust to trust and be trusted - I do like to enjoy giving and taking binding oral contracts myself from time to time, with those whom I feel will play fairly. However, I will use appropriate protection if I have even the slightest of doubts in my mind about the person I am engaging - and it's a pity that Richard doesn't appear to have in this case. And of course, there are times when oral, protected or not, just isn't good enough in anyone's eyes... And sometimes the person needs to be bound far more firmly in line with one's terms.

Well, a deals a deal, and an oral contract for personal services must be specifically performed. Provided, of course, that there is sufficient consideration - in order for a contract to be binding, both parties must benefit from the transaction, such as if each party agrees to perform services for the other. Are you ready to fully perform your obligation?
