I am not going to get involved here other than to say I am guilty of making a judgement concerning Dawkins' case based on reading only a small part of one side of the story and I am going to try to be objective. The final judgement will be made in court.

However trying to defend a 'reputation' with a presence on a pile of forums whose members starting point is openly hostile, given the history, seems somewhat doomed. Masochistic even.

I'm afraid you're wrong Josh. Copyright ownership does not transfer automatically to the forum it is posted to. There must be a clause in the Terms of Use or the Users Agreement which explicitly states something to the effect that "by submitting matieral to [suchandsuch.such] you agree to transfer ownership of copyright of all said materials to [suchandsuch.such]". Obviously that's not strict legalese, but my point is you must have such an explicit clause in either the TOU or FUA transferring ownership of copyright which the members agree to upon joining, or agree to by their use of the forums.

Material Submitted
All materials, photos or videos you submit to any of our forums and other public posting areas become the property of richarddawkins.net and may be reproduced, modified and distributed by richarddawkins.net without restriction, in any medium, and for any purpose. Posting of any material on richarddawkins.net gives expressed waiver and release of any/all rights, legal, moral, or otherwise, to said material(s).

I knew rd.net appropriated the rights to anything posted there (I seem to remember there being a big hoooah over it when it was introduced [it wasn't there from the start]). I was just sayin' it in regards to the first two three sentences of his post that I quoted.

which is why I never post anything on forums which I deem a publishable saying of value (except for one liners and gems of wit and wisdom which wouldn't entitle me to sharing the rights or larger works quoting them anyway)
