A Hampden County man who allegedly tricked his brother's girlfriend into having sex with him by impersonating his sibling in the middle of the night cannot be convicted of rape, the state's highest court ruled yesterday in a controversial decision that affirms the court's long-held view that sex obtained through fraud is no crime.

The Supreme Judicial Court unanimously ruled that a judge should have dismissed the rape charge against Alvin Suliveres , 44, of Westfield, because Massachusetts law has for centuries defined rape as sexual intercourse by force and against one's will, and that it is not rape when consent is obtained through fraud.

If the Legislature wants to make sex through fraud qualify as rape, it should follow the lead of several other states -- including Alabama, California, Michigan, and Tennessee -- and change the law, the court said.

Brownlow M. Speer , a state public defender who represented Suliveres in the challenge, praised the ruling. His client, who has been free since his March 2006 trial ended in a hung jury, denies impersonating his brother and maintains that the sex was consensual.

I simply am aghast at how stupid and horrible and sectarian this is. As someone else pointed out, the same charge could be brought about by a woman discovering that the man is not really a natural blond or something - only it's more insidious... How downright disturbed in your mind do you have to be to have enjoyed consensual sex with someone, and suddenly be repulsed when you discover they're not from the right ethnic group/tribe for you? And to take that to the point of accusing said consensual partner of RAPE for not being clear about that upfront? Fuck off...

Obviously she was really interested in serious relationships, and the sanctity of her body and soul and all that, and we need to protect that - and overlook those times here and there were she has those merry little fucks with men she met the same day (and later accuses of rape if she subsequently finds objectionable)...

This must surely have something to do with Israeli law? The part above suggests that some American states recognise the concept of "rape by deception" while others don't. Presumeably Israeli law does?

The boston.com link that CES posted mentions that several US states, including "Alabama, California, Michigan, and Tennessee" do define sex obtained via deception as rape, while most states do not. If rape by deception is illegal under Israeli law, and the Palestinian man is indeed guilty of rape by deception... then it follows he should be sent to prison for that crime.

We all have laws we don't like, but we have to submit to them or choose to risk the penalties.
