They might have been around, but there is no way it should go against constitutional rights (you don't actually have a written one, do you?)

To get this in perspective... they are arbitration systems. People are free to use other forms of arbitration too (such as counseling or the Jewish courts). They are only binding because the people agree in advance that they will accept the outcome. They don't have to use arbitration if they don't want to (leaving aside cultural pressure).

I don't agree we should have it, but it is entirely voluntary for the participants.

I agree that it is anachronistic. In theory, such 'courts' the equivalent of management and unions settling a dispute through ACAS. In practice, however, they have far greater weight than that due to the wooish indoctrination that surrounds them. They are not officially permitted to pass a judgment that contravenes British law, but...
