Fulton county prosecutors do not intend to offer plea deals to Donald Trump and at least two high-level co-defendants charged in connection with their efforts to overturn the 2020 election in Georgia, according to two people familiar with the matter, preferring instead to force them to trial.

The individuals seen as ineligible include Trump, his former White House chief of staff Mark Meadows, and Trump’s former lawyer Rudy Giuliani.

Aside from those three, the Fulton county district attorney Fani Willis has opened plea talks or has left open the possibility of talks with the remaining co-defendants.

'Tape Of Trump Lying About Penthouse Undercuts His Court Testimony'

Donald Trump testified Nov. 6 in a fraud case accusing him of lying about his net worth to lenders and insurers. Under questioning from the New York attorney general’s office, Trump spoke about his penthouse, which his net-worth statements valued as if it spanned 30,000 square feet, even though it only had 10,996 square feet. Trump’s testimony made little sense, especially when examined alongside a 2015 interview he gave to Forbes.

In court, the former president blamed others for the square-footage discrepancy, even though he personally pushed the lie that his apartment was three times its actual size. An audio clip from the 2015 interview, released here for the first time, shows Trump exaggerating even more than his net-worth statements, claiming his apartment was 33,000 square feet.

“This is the entire floor of Trump Tower, just so you understand,” Trump said in 2015. “This isn’t like, I’ll show you. Now, this wraps all around the building. All around the elevators. And I have three times three. So there’s like 11,000 feet on a floor. So I have three. So 33,000—and I have the roof.” Instead of accepting responsibility on the stand, Trump blamed the phony numbers a non-specific “they”—presumably his former Chief Financial Officer Allen Weisselberg and former Controller Jeffrey McConney. “I think they probably took 10,000 feet per floor,” Trump said. “I could see how it was done. They took 10,000 feet per floor, because the floors are, I believe, about 10,000 feet, and they went times three.”

Trump also testified that he noticed the problem and directed Weisselberg and McConney to correct it on his net-worth statements. In fact, Forbes uncovered the square-footage discrepancy and informed Weisselberg and McConney that the apartment was 10,996 square feet in February of 2017. The Trump Organization nonetheless continued to use the incorrect square footage on a net-worth statement dated mid-March. Forbes then published an article headlined “Donald Trump Has Been Lying About The Size Of His Penthouse” in May 2017. It was only after that story came out—while Donald Trump was in the White House—that the Trump Organization changed its calculation to reflect the true square footage of the apartment.

By claiming he directed McConney and Weisselberg to alter the numbers, Trump seems to be suggesting he was involved in editing his net-worth statements after he became president. That testimony calls into question another sworn statement he gave. During a pre-trial deposition, he claimed that he did not even see his net-worth statements while he was in the White House until the documents were finished. “Once I became president,” he said during the deposition, “I would—if I saw it at all, I’d see it, you know, after it was already done.”

The former president conceded during his testimony this month that his net-worth statements had overstated the value of his penthouse. But even on the witness stand in open court, he couldn’t quite bring himself to say the true size of his longtime home: 10,996 square feet. “I have heard, obviously, because of the trial, they say 11 to 12 to 13,000 square feet,” Trump testified.
