'Fellow Dems Say Willow Approval Leaves "Oil Stain" on Biden Climate Legacy'

Progressives on Capitol Hill joined climate advocates and Indigenous leaders across the country Monday in blasting U.S. President Joe Biden for his administration's approval of ConocoPhillips' Willow oil project on federal land in Alaska.

"The Biden administration has committed to fighting climate change and advancing environmental justice—today's decision to approve the Willow project fails to live up to those promises," declared U.S. Sen. Ed Markey (D-Mass.) along with a trio of House Natural Resources Committee leaders, Reps. Raúl Grijalva (D-Ariz.), Alexandria Ocasio-Cortez (D-N.Y.), and Jared Huffman (D-Calif.).

The four Democrats argued that "their decision ignores the voices of the people of Nuiqsut, our frontline communities, and the irrefutable science that says we must stop building projects like this to slow the ever more devastating impacts of climate change."

In a move widely seen as an attempt to temper criticism of the decision to greenlight Willow, the Biden administration on Monday also announced new restrictions for offshore oil lease sales in the Arctic Ocean and across Alaska's North Slope.

"While we acknowledge that the administration also just announced that it is conserving new public lands and waters in the Arctic, split decisions in the face of the climate crisis are not good enough," the Democrats said. "This administration clearly knows what the path to a cleaner and more just future looks like—we wish they hadn't chosen to stray so far from that path with today's Willow decision. The only acceptable Willow project is no Willow project."

It's some sort of comfort to see that Republicans aren't alone in being willing to sell their principles to the highest bidder.

"This is one of those moments that could be some sort of a tipping point, and all the policy solutions as a result of previous bad, bad policies really aren't ideal," Committee for a Responsible Federal Budget president Maya MacGuineas said on "Mornings with Maria" Tuesday. "And that's where we're stuck right now."

"The point is that when you're structurally weak, which our economy is now because of the fiscal irresponsibility that we've been practicing for so long, anything can set off the problem," MacGuineas said. "And right now, we are already stuck in a very difficult situation between fighting inflation and avoiding recession. That tricky balancing act just became so much more difficult."

If you don't want to be reliant on oil, how about paying us Africans a decent price for our Cobalt?

Until recently, most of the popular EVs contained a battery with cobalt and nickel because it enables them to have a long range in a compact size. Tesla and Ford are now transitioning towards a chemistry without cobalt for their lower range EVs, called lithium-iron phosphate (LFP).

Just business as usual. So yes, the relatively minor reforms here probably would not have even been discussed under a Republican administration. Nonetheless, it's galling that the insurance industry has such ridiculous influence. Medicare Advantage is a gravy train for them.

'"Bending the Knee" to Insurance Lobby, Biden Admin Delays Medicare Advantage Reforms'

The Biden administration announced Friday that it will allow Medicare Advantage plans to continue overbilling the federal government in the short term after the insurance industry lobbied aggressively against proposed rule changes aimed at cracking down on fraud in the privately run program.

The Centers for Medicare and Medicaid Services (CMS) said it is still moving ahead with the changes despite industry pressure to drop or completely overhaul them.

But instead of implementing the reforms all at once, CMS outlined a plan to phase in the changes over a three-year period, a concession to large insurers that dominate the Medicare Advantage market—which is funded by the federal government.

"How Washington really works: Medicare Advantage providers whined for months that they simply couldn't survive without being able to rip off the government, so the government said 'you can rip us off for just a little longer,'" The American Prospect's David Dayen tweeted in response to the CMS announcement.

The changes involve tweaks to the Medicare Advantage risk-adjustment model, which determines how much the federal government pays insurers to cover patient care.

Medicare Advantage plans are notorious for piling on diagnoses to make patients appear sicker than they are to reap larger payments from the federal government. CMS estimates that overpayments to Medicare Advantage totaled $11.4 billion in fiscal year 2022, a sizeable drain on the Medicare trust fund.

"Nearly every large insurer in the program has settled or is facing a federal fraud lawsuit for such conduct," The New York Times noted Friday. "Evidence of the overpayments has been documented by academic studies, government watchdog reports, and plan audits."
