That's probably why Nebraska has been classed as a state with no state-wide mandate in that chart.

De mondkapjesplicht is vastgelegd in een ministeriële regeling, die door de ministers De Jonge (VWS), Grapperhaus (J&V) en Ollongren (BZK) naar de Tweede en Eerste Kamer is gestuurd, tegelijk met de ministeriële regeling met de maatregelen die in de huidige noodverordening staan. Op basis van de tijdelijke coronawet heeft het Parlement zeven dagen om zich over deze regelingen te buigen. De regelingen, en dus ook de mondkapplicht, gelden in eerste instantie voor drie maanden. Na die periode is verlenging mogelijk. Zodra er geen medische noodzaak meer is worden de regelingen weer ingetrokken.

Wanneer moeten we verplicht aan de mondkapjes?

Dinsdag stemde de Eerste Kamer in met de coronawet. Daarmee lijkt de laatste horde voor een mondkapjesplicht genomen. Wanneer zien we heel Nederland verplicht aan de gezichtsmaskers? En waarom kan het elders in Europa sneller?

Verder dan een ‘dringend advies’ is het nog niet gekomen: de instructie om mondkapjes te dragen in publiek toegankelijke binnenruimtes, zoals musea, supermarkten, stations en horeca.

De reden? Het invoeren van een mondkapjesplicht vereist een wettelijke basis, volgens onze Grondwet. Want: die plicht gaat in tegen het recht op de onschendbaarheid van het lichaam. Dat zeiden meerdere staatsrechtgeleerden al toen de mondkapjes in delen van de Amsterdamse en Rotterdamse binnensteden deze zomer werden verplicht.


Ook dan ben je er nog niet, zegt hoogleraar Voermans. “De mondkapjesplicht kan via een zogeheten ministeriële regeling worden ingesteld. Maar zo’n ministeriële regeling moet door de Tweede Kamer worden goedgekeurd. Dat kan een week duren.”

Already demonstrations have taken place against the masks. It is only valid for three months subject to requirement. It can be renewed but once again subject to Parliament's approval.

It is only valid for three months subject to requirement. It can be renewed but once again subject to Parliament's approval.

Good. Similar laws in Australia have also been passed on very much a temporary basis, and subject to review. (I think the most recent lockdown (in Victoria) lasted less than three months.) They are not laws but ministerial regulations that can be challenged at any time by any Chamber and as such have not been through the Second Chamber so they are not legal yet. They have used to fine demonstrators but will rejected by the courts as soon as the cases appear. It is bluff poker.

Tomorrow is the last day but even then Ministerial Regulations can always be challenged in the Second Chamber but laws cant. You have to introduce a bill to do that. Parliament has absolute power here. Ministerial Regulations like a lot of things here, are tolerated.

Do the 7 days not count from the day the minister made the decision? That's already two weeks ago.

Anyways, since the parliament approved the pandemic law recently, I am positive they will not turn into conspiracy nuts overnight.
