Well, in all fairness, I don't think the article says she was unconscious, just drugged on either 'ludes or over the counter benadryl.

I'm surprised he needed the drugs. In my younger days, I found there were enough women around who wanted to do a little this and that -- it was never even a thought to go for someone who didn't want to fool around. I would think a rich celebrity would have a far more target rich environment than I ever had.

For me, the weird part about this kind of case is that I can't wrap my head around a couple of things: (a) a grown man actually acting this way and doing these things and thinking he would be able to get away with it, and (b) getting away with it for decades and involving problem 50 to 100 women, or whatever number they're saying (a whole lot). The reason I can't wrap my head around it is that both of those things seem so alien to me. I would never think I could get away with that for a second, nor have I ever met anyone who has suggested it.

I haven't followed the testimony closely. Seems like a lot of smoke for there to be no fire. And, he has admitted giving 'ludes to women and such. I guess giving 'ludes to a woman is not necessarily rape, but it is a confirmation of part of the allegations against him, and it certainly can be rape, if she didn't want the ludes and didn't want to have sex.

The defense is not that "drinks and fireplace = consent" or that "she led him on." The defense is that this was a romantic interaction, that he was taking her to dinner, buying her gifts - coming on to her and such - and that she went on dates with him, had romantic dinners at his house, laid on his bed with him, and such. These are often the kind of things that happen when two people are dating, and you can't generally point to one particular thing that is, in and of itself, consent. Consent is evidenced by words and actions, and so if you're asked, as a jury is, to determined whether someone consented to sex, the only thing you can go by is what people say and do - all the facts and circumstances.

It's pretty rare that any of us will have a recorded verbal "yes" to offer third parties to prove innocence. At best we will have objective facts that tend to show consent.

From what's been reported, this all looks pretty damning for Cosby. I am always shocked by the new things I hear. What's with this conversation with the mother, where he calls her "mom" and then talks about fingering the daughter, but not penetrating her, and notes that she "even had an orgasm." the hardest part for me is believing that anyone would talk like that. But, there is so much of that in this Cosby thing...

The key for me so far is that Cosby has admitted to giving the women drugs which are illegal to have and dispense without a prescription for the express purpose of loosening them up, putting it mildly. The testimony regarding the incident here being a romantic interlude doesn't seem to hold up very well. It's not really persuading me.

Now, we have to back up to the burden of proof, and we know we would have to acquit if there was "reasonable doubt." But, I keep coming to the conclusion, no matter how hard I try to raise a doubt, that I have a definite and firm conviction that a crime was committed here. I don't have reasonable doubt, based on my best attempt to objectively read the evidence, trying to figure out where that reasonable doubt is.
