It's California. Anything might apply.
In this country, as well as the appeal being an opportunity to re-examine sentencing, the prosecution can actually appeal the leniency of the sentence, which they regularly do, in blatantly stupid cases like this.

In the UK it's high on impossible to get the full sentence for anything, save for especially terrible crimes, or if you thumb your nose at the court and/or the judge. The appropriate thing to do would be to compare the sentence with similar cases and see if there's a disparity. If not then you can say it is a structural thing with weak sentencing, or if there is you can argue he's got the white guy treatment. I don't know the specifics of what he actually did so I don't know what sentence is appropriate. If he groped her over her clothes or something like that then those screaming for blood are the usual drama queens. If we're talking rape or a more serious assault then it looks like he got away with it.

I'm not surprised that Biden weighed in. I am, however, surprised that Obama hasn't. The Democrats and the left in general are falling over themselves to dive on anything like this to score votes. I don't think for a second that he really gives a toss. He's a politician and he's just trying to nail the women's vote for Clinton. Defending the tiny little woman is easier than actually doing something, like prosecuting criminal bankers or rebuilding black cities etc. There will be more of this sort of thing now that the US election is nearing.

Personally I'm getting really bored of these people being hung up like fly paper for the public to attack and rage about. Prosecute them solemnly and if found guilty pass sentence soberly and promptly. The rest of this is just media fluff.

I just said I don't know the details. First rate detective work there. Bravo. That aside, it's called unconditional love for a reason. It means that no matter what, I love my children and will be there for them in all circumstances. Maybe that's not important to you but it is to me.

And I knew that 'what if it was your daughter?' was coming, as if the plight of the victim is what motivated you to reach your conclusion. It's the same as the pro capital punishment crowd. You don't care for the victims, you just want your pound of flesh. Which is fine, I don't care what you think about that, but I get really very irritated when people try to dress that up as a virtue and act as though the pretence of their opinions is either convincing, compelling, or somehow meritorious. If you're prepared to throw your son under the bus them that's your call. In general, no. In some states I think they can appeal the sentence to a higher court, but I'm not certain about that. Usually once it's done, it's done.

Aside from that there was nothing wrong with the trial. It's the jail term that has upset so many people. I'm no lawyer but I'm pretty sure that you can't declare a mistrial when there wasn't one.
