I could say it differently; did Mickey Rourke's character, in the mind of a modern viewer with today's conception of rape, initiate rape against Kim Basinger's character in that scene? They were engaged in a physical struggle when he forced himself into her after positioning her and tearing off her panties - her struggling against him all the while and crying out 'no' in what seemed like a genuine combination of denial, fear, and anger.

So was what was portrayed considered rape and is it considered rape now? I think the answer is 'no' and 'maybe - probably' respectively.

A more interesting question is where will it all end? Say 10 or 15 years from now? Will this be considered a historical sex crime? I keep following the money, makes things like this easier to understand....

There were some films with precisely that scenario made between between the mid sixties and the mid seventies with similar scenes as well. Butch Cassidy and the Sundance Kid (1969) comes to mind, and I have seen a more blatant one with Clint Eastwood in one of his spaghetti westerns on Youtube a few months ago. Also, one involving Charles Bronson. It won't surprise me if I discovered there were more.
