If he heard movements behind the toilet door it would have been reasonable to expect hearing a flush next. It's what normally happens. I don't know why the judge saw any solid footing in the defence's argument.

it's almost a shame that the judge is so punctilious. her argument for not convicting on the murder charge is that the prosecution didn't make a convincing (beyond reasonable doubt) case. never mind the fact that pistorious appears to be an entitled whiner, who probably shot shit out of the door in a fit of pique, reasonable doubt allows for him to be confused and frightened. the judge is giving him the benefit of that doubt.
