A police officer has been acquitted of assault and misconduct after Tasering a naked man who threw a pair of underpants at him during a strip search.

Pc Lee Birch, 30, discharged his weapon into the bare chest of Daniel Dove in a cell at Melksham police station in Wiltshire in the early hours of December 23 2012.

CCTV footage of the incident, which was used as evidence in court, can be viewed above (Warning: graphic content).

Pc Birch had arrested Mr Dove earlier that morning, outside MooMoo nightclub in Trowbridge after he was ejected by door staff following an altercation with another clubber.

Mr Dove allegedly punched Pc Birch in the head during his arrest, before kneeing another police officer in the groin three times, Bristol Crown Court heard.

He was taken to Melksham police station and put into a cell, where Pc Birch - who had unholstered his Taser and concealed it behind his back - and two other officers began a strip search.

Mr Dove claimed he felt "humiliated" when he was instructed to remove his wet boxer shorts and flicked them in the face of Pc Birch - hitting him in the eye.

A CCTV camera in the cell caught Pc Birch instantly swing his arm round, point the Taser at Mr Dove and discharge the weapon without any warning.

Yeah, but a cop is supposed to restrain his instincts and respond professionally, not go ballistic. Even though the cop was acquitted in this case, I don't think he acted appropriately. Flicking wet shorts at you is not a serious physical threat. Mind you, I couldn't get the vid to play all the way through.

But using a taser, although it might be over the top, is not as permanent as a gun...

Cops aren't supposed to mete out justice. They guy was in a cell. All they had to do was walk out the door and lock it.

I've pointed this out on numerous occasions, and here it is again.

In these instances, the police, and the prosecutors, deliberately bring a weak case. Their objective is to bring the case and lose. So they look like they are not being soft on police misbehaviour, but they don't lose a trained officer, or damage police morale. And it works every time.

They know exactly how to bring a case that is just strong enough to have gone through the motions, but weak enough to ensure a not-guilty verdict. So now, they have the desired result. They have covered their backs. The officer is cleared, not by them, but by a jury. And the jury wouldn't take a lot of manipulating anyway. The injured party wouldn't invite much sympathy, he seems to be an asshole.

All the prosecution had to do was go through the motions, without REALLY giving it their best, and they knew that the jury would acquit.

The process is the same here, as in the US. The only difference here is that the mug is still alive.

Since being harassed by the police for photography in a public place, I've wondered if it's possible to charge them for one's time...Say, £1000 initial consultation fee then £100 for every minute they keep you from going about lawful business.
I know it sounds somewhat outrageous, but I can't think of any reason why not...As long as no offence has been committed.
Perhaps any lawyers present could respond as to the legality of this tactic?
