The "Lousy Canuck" - a real scumbag, whined about this, then it turns out that he's guilty of releasing ip addresses and emails himself here.

Then, as the last comment, he explains his policy to people complaining:

I also made this point elsewhere online, but Thunderf00t had access to the "backchannel" of FftB before when he was invited. He had access to all the email addies, and whatever sensitive information they might have had, back then. Do they think he deleted everything, or didn't save it on his own? Did he just forget everything? Do they also realize that everyone who joins there has the same access, even psycho-stalker Laden (he of the "men are women whose brains have been damaged with testosterone" fame)? They routinely publish emails (PZ is famous for it, as is Ophelia - who then went crying when someone published one of hers, and Justin G - except he published Laden's infamous email that forced the ruling elite to boot Laden, and he was subsequently chewed out by PZ for it). The hypocrisy burns!

Nevertheless, I think thunderfoot may have gone too far, and if the federales get involved he's going to serve some time. He's already admitted that he had unauthorized access. The lousy Lousy Canuck makes a reasonable case that he re-applied for access after access had been explicitly revoked. His only real argument could be "look, I was a blogger on FTB, I had access to this information, and they just left the door open after they had thought they'd closed it. Except one issue will be his state of mind when he re-authorized himself surreptitiously. I don't think he'll be able to convince a jury that he thought, as a tossed-out blogger, that he still had permission to access the listserv.

Hacking is legally defined as “the illegal entry into a computer system through unauthorized means." He was obviously "unauthorized" and knew was he unauthorized. And, sadly for him, he admits all over the place that he was the one gaining entry.

Even TF's claimed moral high ground is rather marshy. The one leak that seems justifiable is where he quotes Ed Brayton emailing about how he wants TF "drummed out" of the freethought community. But Brayton said this in the context of TF's leaking in the first place.

It's going to be sad that PZ gets the last laugh on TF.

So if say Pappa or another admin on this site informed you that you could no longer visit here, but you then proceeded to post, you would be guilty of hacking? Really? What if you didn't even post, but just looked at the website? Hacking? By your description above, it would have to be, as you accessed their server after being told you could no longer visit the site.

what thunderfoot did was re-login to the listserv after he'd been denied access.

blog =/= listserv
posting on a blog =/= gaining unauthorized access to a listserv

the only legal fine-tuning will be how the federal hacking law applies to listservs, as opposed plain email accounts. and, again, how prosecutable TF is, since he previously had access. his defense might be, "Hey, I was just innocently relogging in again-- and i got access through the original authorization email-- it's not my fault if they intended that i remain unauthorized and just didn't shut the door." Of course, this is belied by his thorough online confession. thunderfoot should seriously shut up now.

plain email account hacking is clear: the Sarah Palin hacker got 12 months for his exploit.
