Maybe. Under those grounds, though, every street preacher should be arrested as well. I've never been convinced that Christians preaching hellfire is a personal threat. I would say it's more in the realm of a warning of possible consequences. Like if someone were to be declaring that everyone should wrap their left pinky in tin foil, else Godzilla will destroy the entire city. It could also be argued, I guess, that the Phelps are in fact threatening; I seem to recall them saying we're all going to be sent to Hell. Sounds pretty threatening to me, I wonder if something could be made of that?
