In the real one she's not quite as beautiful as Cate Blanchett, but she's got the look.

What it looks like to me is that Josh planned an intellectual rights defense from the start. This also explains why he turn over the books so easily after UK law changed giving RDF the power to run the store themselves. The authority to hire his own help is one of the many legal litmus test for that argument.

Sad thing is Josh has some likelihood of winning the intellectual property augment on some items. It'll be an itemized battle though. It sucks that Josh could use foreknowledge of his legal position to preplan embezzlement. It looks like RD probably holds an ace card on the main points though. This is just my opinion based on going through the court documents and bits of factual history.

Of course, the fact that the site, logo, etc were to be associated and used by an organisation that was paying him handsomely for the work do point to work for hire... now, I'd like to know what the standards and precedent of California law are... I suspect that work for hire has an advantage, but I'd really like to see a real expert's take on that shambles.

Copyright law is a minefield, with lots of unknowns. It's a dangerous defense. Especially if it can be demonstrated that it was intended as a tool for embezzlement in this case. Also, RDF actually purchased copyright for some of that material from a third party. It is not then transfered to Josh by lack of contract or verbal dispute. The FTC could possibly get involved also, due to marketing representations.

Even the context of the word "Lovely" on Josh's website came close to tipping a legal strategy. The lawyers are as lost as the average citizen once you get this far into copyright law. This case could very well set precedence.
