Re: Abortion USA
Fox News summary: Indiana Republican Gov. Eric Holcomb signed a bill Friday evening prohibiting most abortions.
The new law bans the procedure except in cases of rape, incest and to protect the life and physical health of the mother. The rape and incest exceptions only apply in the first 10 weeks post-fertilization. Victims would not be required to sign a notarized affidavit attesting to an attack, which had previously been proposed.
Abortions will also be allowed if a fetus is diagnosed with a lethal anomaly.

Said Peter...what you're requesting just isn't my bag
Said Daemon, who's sorry too, but y'see we didn't have no choice
And our hands they are many and we'd be of one voice
We've come all the way from Wigan to get up and state

Re: Abortion USA
South Dakota woman no longer willing to put women in jail. Only the providers.
“I don’t believe women should ever be prosecuted,” she said. “I don’t believe there should be any punishment for women, ever, that are in a crisis situation or have an unplanned pregnancy,” she said. The governor also set up a website for pregnant women that aims to “help mothers and their babies before birth and after by providing resources for pregnancy, new parents, financial assistance and adoption.”

Re: Abortion USA
This was a home abortion past 20 weeks.
https://nebraskaexaminer.com/2022/08/10 ... UvSUAEHBZICeleste, who is now 18, is being charged as an adult with removing, concealing or abandoning a human body, which is a felony, and with concealing the death of another person and false reporting, which are misdemeanors.

Her mother has been charged with three felonies: performing an abortion after 20 weeks; performing an abortion as a non-doctor; and removing, concealing or abandoning a human body. She also faces two misdemeanors: concealing a death and false reporting.
Police allege in court documents that both mother and daughter knew a drug being ordered online was intended to cause a miscarriage. The mother said she could not remember the name of the drug or what website she had ordered it from online.
U.S. Rep. Mike Flood, R-Neb., author of Nebraska’s 20-week ban, said the law recognizes late-term abortion as “especially cruel and inhumane.”
Flood said he has “always supported commonsense restrictions on abortion.” He also has said he would support an outright ban on abortion in Nebraska and federally.
His opponent in November’s general election, State Sen. Patty Pansing Brooks of Lincoln, worked with other Democrats this year to filibuster Republicans’ effort to pass a full ban.

An orphan girl from Florida was denied the right to get an abortion because she could not produce proof of parental consent.

Tweet from a Planned Parenthood spokeswoman...
'Fears of Another Supreme Court Assault on Abortion Rights Grow After Idaho Ruling'
This is in regard to the Emergency Medical Treatment and Labor Act of 1986 (EMTALA) which includes a provision that doctors providing emergency care 'effectively identify problems and treat them promptly so patients are stabilized before they develop a life-threatening emergency.' A judge in Idaho ruled that this must be interpreted to include abortion, if continuing the pregnancy would lead to a life-threatening condition. The zealots are incensed, and more significantly, a judge in Texas had already made a contradictory ruling. Both cases will likely to be appealed, and given the appeals courts they will be heard in, the lower court ruling likely to be upheld. Next step for either case would be the US Supreme Court.Abortion rights could be in front of the Supreme Court again, sooner rather than later.
I can't believe in a matter of months we've gone from losing the Constitutional right to abortion to debating whether doctors can provide lifesaving care to patients.

'Fears of Another Supreme Court Assault on Abortion Rights Grow After Idaho Ruling'
Reproductive rights advocates on Wednesday applauded a federal court ruling in Idaho allowing doctors to provide abortion care in cases of medical emergencies, but legal experts warned the decision could mark the beginning of the next fight over abortion rights at the U.S. Supreme Court.
Judge B. Lynn Winmill of Idaho's Federal District Court ruled that the state's near-total ban on abortion care violates the Emergency Medical Treatment and Labor Act of 1986 (EMTALA), siding with the U.S. Department of Justice.
The DOJ sued Idaho over the ban, arguing that doctors are required under EMTALA to provide stabilizing medical treatment to anyone who comes to an emergency department, and that includes pregnant patients who need abortions to treat medical emergencies.

Re: Abortion USA
I don't get it, what makes this PP lady even think this might happen? I mean, one trait of SCOTUS is that they hear only what they want to hear, and I don't think THIS court is ready to hear new cases on the subject now that their duty is done.

If federal appeals courts are handing down conflicting opinions, the US Supreme Court is more or less compelled to do its job.

Re: Abortion USA
What conflicting opinions? They killed Roe v Wade and decreed that reproductive rights were firmly a states rights matter. I don't see how a federal court, even the notoriously cantankerous ninth circus, could so successfully adjudge that they should be a federal matter that the Nazgûl would have to grant certiorari.

Re: Abortion USA
They didn't exactly say that. Merely that the constitution did not give it to the feds. They could later come up with some Alito ressoning that allows the feds to block abortion by law. Maybe some other parts or just his "rooted in tradition" phrases.

Re: Abortion USA
Bugger alito and his trying to reason with the ostrich brain nature gave him. They are not going to give it back to the feds, because what one law can do, another can undo, and they know that they can't win that tug of war in the long run. As for the 'rooted in tradition' bits, I might have trusted scalia to use that one, because even with his obvious and assumed bias, he still was fundamentally honest (or managed to look that way), but if anybody else uses it, you can cry cherry picking.

Re: Abortion USA
There is some rumbling about more abortion bans. The republicans think they can ban all abortion. With a Republican president.
All that the courts decided is that the constitution does not provide the freedom to abort. It then left the matter to the states. Since there is no federal law. But it does not prevent a federal law later. The court did not state that this right goes to the states for all times, merely that in the absence of federal law it goes there, for now.

Re: Abortion USA
It could actually backfire, if the supreme court rules too many times. The semocrats could pass a law, though there is unlikely a 60 vote senate support in the next few years.
