The former is a red-herring, as it's a positive claim. The latter absolutely is a negative claim. The exact same type of claim in Russell's Teapot.

A proof of impossibility or an evidence of absence argument are typical methods to fulfill the burden of proof for a negative claim.
That clearly doesn't apply on universal scales. How much of the universe do you expect we'd have to investigate before we could declare that enough burden of proof had been met?
