The confusing part is that we have federal courts and they fall under the justice department, except the supreme court. So the president is responsible for courts that might investigate the president. A criminal president can do whatever he feels like. He can order the FBI to stop investigating some particular thing.

I just don't get it, justice thomas and the late justice scalia are well known for right wing attitudes, bordering, of worse, on being fascistic, yet, they were among the dissenters against the parody that was Kelo vs New London... I must admit that at the time, that attitude gave them my respect.

'Judge Finds Trump's Attempt to Overturn 2020 Election Was Likely a Felony'
A U.S. federal judge on Monday found that former President Donald Trump and legal adviser John Eastman probably committed felony obstruction in their efforts to overturn the 2020 presidential election.

The government watchdog group American Oversight said the ruling is a "clear call for accountability and further investigation of the attempt to subvert the election."

In his 44-page ruling, U.S. District Court Judge David Carter wrote that Trump and Eastman "launched a campaign to overturn a democratic election, an action unprecedented in American history."

"Based on the evidence, the court finds it more likely than not that President Trump corruptly attempted to obstruct the joint session of Congress on January 6, 2021," the judge asserted.

Carter also found that Trump, Eastman, "and several others entered into an agreement to defraud the United States by interfering with the election certification process."

"Their campaign was not confined to the ivory tower—it was a coup in search of a legal theory," he wrote. "The plan spurred violent attacks on the seat of our nation's government, led to the deaths of several law enforcement officers, and deepened public distrust in our political process."

I've found that conservative judges are often quite different from conservative politicians in that they focus more on law than policy and that can play out quite differently in practice. Kelo v New London held tax revenue as a public use sufficient to justify condemning an entire neighborhood, which would be anathema to an originalist view of the term.

Besides, it was a hateful decision. :nono:

Funny, I am not an originalist, since I'm no scholar of that stuff and could not know what views modern scholarship ascribes to the Founding Fathers, but I sure agree with this, since the prospect (and hope) of tax revenue certainly is no justification to deprive a citizen of his property and hand it over to venture capitalists who still may totally flop, or maybe just make a megabuck and cut away with no mind on whether the scheme was sound, only that it was short term profitable.

Yeah, IIRC the business park that was supposed to be built never was, and the company closed their facility when the tax breaks ran out.

That and the Korematsu decision really stick in my craw.

I don't think so, but interestingly the current Roberts had the opportunity to weigh in on Korematsu in his opinion in Trump v Hawaii.

Federal prosecutor types are using the term 'consciousness of guilt' with regard to this development.

'White House records show 7-hour gap in Trump's phone calls on Jan. 6, reports say'
Internal White House records from Jan. 6, 2021 -- the day a mob of pro-Trump radicals attacked the U.S. Capitol in a bid to subvert the results of the 2020 presidential election -- show a gap of more than seven hours in then-President Donald Trump's phone logs, according to news reports Tuesday.

The White House records, which were recently turned over to the House committee investigating the Jan. 6 attack, show that the gap is seven hours and 37 minutes long.

The Washington Post and CBS News reported the gap in Trump's phone records after receiving copies of the documents.

The records show no notations for any phone calls placed for a total of 457 minutes between 11:17 a.m. and 6:54 p.m., which covers virtually the entire duration of the Capitol attack.

For that sort of person, and generally, it equates to being aware of the negative implications for themselves should the wrong people get their hands on particular evidence. The act of withholding evidence indicates such awareness.

Does this mean Trump did no actual presidenting for the seven hours during the riot that day? What does his expense claim look like for Jan 6th?

The 'coup memo' lawyer Eastman tried to block release of some of his emails pertinent to the planning of Trump's attempt to overturn the election. The judge ruled that most of them must be released; below a couple of selected passages from the ruling.
The evidence shows that Dr. Eastman was aware that his plan violated the Electoral Count Act. Dr. Eastman likely acted deceitfully and dishonestly each time he pushed an outcome-driven plan that he knew was unsupported by the law.

President Trump and Dr. Eastman participated in numerous overt acts in furtherance of their shared plan. As detailed at length above, President Trump’s acts to strong-arm Vice President Pence into following the plan included meeting with and calling the Vice President and berating him in a speech to thousands outside the Capitol. Dr. Eastman joined for one of those meetings, spent hours attempting to convince the Vice President’s counsel to support the plan, and gave his own speech at the Ellipse “demanding” the Vice President “stand up” and enact his plan.

Based on the evidence, the Court finds that it is more likely than not that President Trump and Dr. Eastman dishonestly conspired to obstruct the Joint Session of Congress on January 6, 2021.

If Dr. Eastman and President Trump’s plan had worked, it would have permanently ended the peaceful transition of power, undermining American democracy and the Constitution. If the country does not commit to investigating and pursuing accountability for those responsible, the Court fears January 6 will repeat itself.
