Slate: But before we get to the question that the court agreed to hear, I wanted to just tee this up by asking: Is there a live case or controversy at issue with the good fishermen of Loper Bright?

Mark Joseph Stern: Thank you for asking that question—the answer is no! These cases are about a federal law that requires observers to join herring fishing vessels to ensure that they’re complying with overfishing rules. In 2020, the Trump administration directed the fishermen and their companies to help cover the costs of bringing monitors on their boats. The fishermen sued and argued that the statute doesn’t explicitly authorize the government to make industry cover compliance costs. They said: We want our money back. We don’t want to have to keep paying for these monitors.

And the federal government agreed to do all of that! The federal government shut down this cost-sharing program. The federal government repaid all the money that the fishermen paid observers. It said: We are making you whole again. We are giving you all of your cash back.

Everybody should have been happy. But they weren’t. Why? Because by that point, conservative legal activists like Paul Clement—who argued Loper Bright—had seized on these disputes as a vehicle to try to overturn Chevron deference. The entire conservative legal movement lined up to push this case onto SCOTUS’ doorstep to kill off Chevron. And so even though there is no more live case or controversy at all, and zero chance of this cost-sharing program ever restarting, this is still somehow an active Supreme Court case that will get a decision on the merits.

It's a bit odd how Trump dogma up to the tiniest detail has been absorbed by GOP polticians. They have memorized most of the details from his Twitter days and whatever they gather from Truth Social. It does not have to make any sense politically. It is just dogma till election. Whales getting beached due to "windmills" is the only bit I have not heard them repeat.

They only need to pass the budget stuff. And prune out as much of the "woke" items as possible.

There could be major international events for the 10 months and we only have whatever power Biden has to deal with those.

We had a small number of farmers that went democrat the last ten years. Some are quite up to date on things like soil erosion, and the tar sands pipeline pushed a few more farmers to the left. The ranchers never did.

Iowa is closer to democratic Illinois, so they always had some democrats in the rural population.

Not sure why we bother primaries with a sitting president. But yeah, polls reach some random set of people. Whoever bothers to answer a phone. In 40 years I've never been polled in a nonpartisan poll.

To be fair the funding is there, and they will eventually agree to more funding, albeit at lower levels than requested. I also support military spending—sorry comrades, but the world is ugly—but it’s not a good look for the government to show a lack of urgency for spending on our problems, and worse playing politics with that funding.

They can throw up all kinds of excuses, but really it probably just comes down to a belief that somehow they’re getting more for their—lol their—money elsewhere.

We just don’t have the culture of accountability towards the cowboys that we do towards the average man on the streets, which is ridiculous given the cowboys many failures.
