It wasn't satire, and in essence I disagree with the principle of having laws against 'disparaging religion,' that are aimed at 'protecting religious feelings.'

'Calling Prophet Muhammad a Pedophile Not Protected by Free Speech, Court Rules'
The European Court of Human Rights (ECHR) ruled that calling the Prophet Muhammad a pedophile was not protected by freedom of speech laws.

The case was brought by an Austrian woman in her forties identified only as "E.S.," who was convicted of disparaging religion and fined $546 for branding the founder of Islam a pedophile during a seminar in 2009.

According to Deutsche Welle, the court, which is based in Strasbourg, France, said the Austrian judge that first ruled on the case correctly weighed the woman’s “right to freedom of expression with the right of others to have their religious feelings protected, and served the legitimate aim of preserving religious peace in Austria.”

The charge stemmed from two seminars called “Basic Information on Islam” that had been organized by E.S. During the meetings, she spoke about Muhammad’s controversial marriage to Aisha, which, according to Islamic tradition, was consummated when she was 9 years old and Muhammad 50.

I'd serve time for that. We live in a secular society where religious adherence is entirely voluntary. Anyone inciting hatred and violence aside, expressing a low opinion of religion is my business and not the business of some appointed guardian of religious exceptionalism - and any Iman or Bishop who disagrees with me can suck my salty balls.

The European Court of Human Rights (ECHR) noted that the Austrian courts had held that ES was not making factual statements but value judgments partly based on untrue facts and without regard to the historical context.

The Austrian courts had drawn a distinction between paedophilia and child marriage, which was also a common practice historically in European ruling families.

Religious beliefs must be subject to criticism and denial, the ECHR observed, but where statements about religions went beyond critical denial and were likely to incite religious intolerance, states could take proportionate restrictive measures, the court said.

ES’s statements “were not phrased in a neutral manner aimed at being an objective contribution to a public debate concerning child marriages but amounted to a generalisation without factual basis,’’ the ECHR held, adding that the moderate fine imposed on her could not be considered disproportionate.

Reading about the background of this case, I think that 'ES' was indeed aiming at inciting religious intolerance, but that doesn't change my disagreement with the principle embodied in the law she violated.

Well one of the (very few) positive outcomes of Brexit is that we will no longer be party to the ECHR. Generally I'm in favour of its rulings, but certainly not this one. Let's hope the UK doesn't follow suit.

Brussels is seeking to bind the UK to the European court of human rights after Brexit in a move likely to infuriate those in the Conservative party championing a break with the Strasbourg court.

A document outlining the European commission’s position on future judicial and police cooperation stipulates there will be a “guillotine clause” on any security deal should the UK leave the remit of the court.

The court, which is entirely separate to the EU’s institutions, was established after the second world war as an arbiter of disputes over the European convention of human rights, to which 47 states are signatories.

However, it has long been the aim of some Tories for the UK to leave the convention, which they say restricts parliamentary sovereignty.
