Fresh Brexit challenge in high court over leaving single market and EEA

A fresh set of legal challenges asserting that the UK will remain within the single market and the European Economic Area after Brexit have been lodged at the high court.

A group of four anonymous claimants have joined a judicial review of government plans to leave the EU, alleging that separate parliamentary approval is needed to quit the EEA.

The new challenges issued on Thursday will consolidate the case already initiated by the pro-single market organisation British Influence. The government and the European commission insist that the UK departs the EEA at the moment it leaves the EU.

But article 127 of the EEA agreement requires contracting parties, which include the UK, to give at least 12 months’ notice before leaving, the claimants point out. That, they maintain, implies a separate departure process from the one in article 50 of the EU treaty that has been disputed in the supreme court...

We'll stumble into this Brexit thing one way or another. It won't be the Brexit people voted for, nor will achieve all or any of what Brexiteers were promised, but if it disentangles the UK from its obligations to the ECHR and allows the Tories to close the border then it'll be hailed as a great victory for democracy. We are to live in illiberal times it seems - at least for the next 20 years or so.

So, British financials will not have market access to the EU after the Brexit, welcome to the club!
Banks, insurers and asset managers have concluded there is no realistic chance of maintaining full passporting rights after Brexit that would allow them to sell all their services across the 28-nation bloc from Britain.

And I am here to tell you that they have a problem. Because you if have no market access, you have no market share. Same thing happened in Switzerland, no market access of Swiss banks to the EU, only reverse solicitation allowed, no proactive cross-border operations out of Switzerland allowed. This is why I left that banking industry that is shrinking and bleeding.

The UK a block? It will be a third rate little island. It depends on financial services for 80% of its income. Plenty banks and institutions are already making plans to leave the City of London. What will be left anyway of the UK? Little England?

Anyway, I was referring to the barriers between Switzerland and the EU. A situation soon to be mirrored between the UK and the EU - and not just in banking.

It is still a long way away even if it does happen. I still dont think it will. As more and more details appear over the consequences I think there will be only one conclusion; dump it.
