Supreme Court already ruled that feds rightly own occupied refuge
Occupiers of the Malheur National Wildlife Refuge question whether the federal government has unequivocal legal rights to own and manage that land, without regard to the wishes of local property owners and ranchers.

Improbably, the U.S. Supreme Court has ruled on exactly that question, specifically regarding the lands of the original Malheur national refuge -- twice.

Those rulings by the nation's highest court, in 1902 and in 1935, found that the federal government has an incontrovertible claim to the refuge's wetlands and lakebeds, dating back to the 1840s, when Oregon was still a territory.

"Before Oregon was admitted to statehood, the United States is shown to have acquired title which it has never in terms conveyed away," Justice Harlan Stone wrote in 1935.

The decisions underscore the area's long record of controversy over land rights -- and show that the current occupiers' claims are not backed by historical fact.

I stopped listening when the person, who described herself as a constitutional attorney, said: "This is about a federal government that is operating outside the supreme law of the land. The people are not acting lawlessly. It's the federal government that is acting lawlessly" Doesn't really gel with the two SCOTUS verdicts Piscator quoted in the post above yours, does it?

The federal government claims title to most of the land in Harney County, the ninth largest county in the United States. Bundy and Payne maintain that Article 1, Section 8, Clause 17 of the U.S. Constitution limits what the federal government can own, and that the government's claim to much of Harney County violates that limit. The federal government consequently has no authority to prosecute the Hammonds.

Like religious zealots, they also pick and choose what they will pay attention to. The standard thinking (article of faith) among a certain self righteous libertarian element is that the Constitution of the United States was written to "restrain the federal government." One would think that such a document would not overlook land ownership, which after all was an extremely important issue at the time it was written (that hasn't changed all that much). Guess what, it doesn't. Article 4, Section 3, Clause 2
The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State.
I should have been clearer in my last post in this thread. As far as I'm concerned it goes without saying that the phrase "Tea Party lawyer" equates to "full of shit liar."

One video from inside the headquarters kitchen shows the wife of one of the militants taking food from a well stocked refrigerator, preparing to cook grilled cheese for lunch and spaghetti for dinner.

But as the occupation comes to its sixth day, it's not yet clear what sacrifices the militants who have occupied the refuge are willing to make.
