“Leaders rarely take up arms themselves,” they wrote in a filing. “It would make no sense to adopt a legal standard that gives a free pass to those—like Trump here—most responsible for an insurrection.”

I can't imagine the Supreme Court going to the goofiest Trump team argument. That Trump could run and win, and only after that courts would he able to label him an insurrectionist.
(That would give the VP the presidency or the House the vote),
The separating of "running" and "becoming" as two steps is not in the Constitution.
Alito spoke and I brlieve he is going to steer this in the direction where the Volorado court has somehow too much power. He also wants to question the "self-executing" part of the 14th amendment.

In the amendment itself, congress has the ability to paas laws on how the amendment is to be applied to a real candidate.

The way this is going: in a week or two the judges will uphold the immunity decision. They want Trump charged for insurrection. Then they refuse to rule on the 14th amendment and colorado until the Jack Smith case is resolved in court. Or more likely a hung jury. If the election takes place and Trump loses, Smith will not try him again on this case, only the minor crimes.
Trump will remain on Colorado ballot as this all comes together just before election.

One of the judges, maybe Alito, pointed out you can be an officer with no office, for which you made some oath. I think it's probably a good thing for Colorado to lose. There's too much ambiguity in the amendment.

They seem to want evidence or some record. Or a "planned" insurrection.
The amendment allows federal legistlation. One can write quite easily a law then that applies only to the president. This would make sense, as the president is elected by the whole country as well as the vice president. All other treasonous politicians can be tried at the state level.
