Doubtful. Whatever they decide, this is a big case and they're not likely to pass up the chance to influence the Supreme Court's thinking.
Like the gang of five gives a shit what some District Court says.
What do you think is being appealed when it gets to the Supremes? The ruling and reasoning of the lower courts.
Plus, four of the Justices: Thomas, Roberts, Kavanaugh, and Jackson served on the DC Circuit before joining the Supreme Court. They might be interested in what their former colleagues think.

Maybe that is what they’re doing by asking congress to handle it: hey jokers, who ya foolin!?
I think they're assuming that Congress will always be able to impeach a Democratic president but never a Republican one. Therefore immunity can be functionally applied to Republican presidents. And that may make strategic sense, considering the gerrymandering and voter suppression etc, but it does place Congress above both the law and the courts.

"The only wiggle room for the Supreme Court would be if they decided that a president wasn't one of the officeholders who should be disqualified from holding the most important office of the United States after he tried to overthrow the government," Kirschner said.
"As sure as I am that the Supreme Court will not rule that Donald Trump is a king and is above the law and has absolute immunity, I'm not entirely sure that the Supreme Court won't twist itself into pretzels trying to find a way to say a president gets to engage in insurrection, and still hold office," he said.

the last bit says the political maneuvering by his opponents and he had clear immunity. He was showing " bold fearless executive leadership" in the election. Presumably if they had got anywhere, he would have thrown out all mail votes because...er....they voted in person when the founding fathers ran things.
If Trump is convicted of a felony at the federal level or in New York, he would be barred from voting in his adoptive home state of Florida, at least until he had served out a potential sentence.
Colorado authorities are investigating possible threats against state Supreme Court justices, Denver police said on Tuesday, one week after the court's decision barring former president Donald Trump from the state's presidential primary ballot.
The Denver Police Department also said it was providing "extra patrols" around the homes of the justices, who ruled 4-3 on December 19 that Mr Trump should be disqualified under a little-known clause of the US Constitution's 14th Amendment for engaging in insurrection.
Trump has been barred from Colorado's primary ballot. What happens now?
The push to bar Mr Trump from the presidential race under the US constitution's insurrection clause is gathering steam and appears to be headed straight to the Supreme Court.
Two nights later, Denver police officers were dispatched to the home of one of the justices in response to a call for service that police afterwards described as an apparent "hoax report", adding they were still investigating the incident.
Republican strategists have suggested the Colorado ballot ruling, likely head for a US Supreme Court appeal, would spark a backlash among political conservatives by reinforcing the narrative that Mr Trump is the victim of a partisan legal process.
NBC News and other media outlets have since reported the emergence of violent rhetoric on right-wing online forums from Mr Trump supporters aimed at the four Colorado justices who sided against him.
The posts in question included messages calling for the justices' personal information to be publicly exposed, and an apparent reference to the judges that said: "All f**ing robed rats must f**ing hang."
Even those who identify with the two political parties are uneasy about whom their organizations will nominate. A recent AP-NORC poll found that Democrats and Republicans are also not especially confident that their party’s primary contests will result in a candidate who can win the general election in November. Additionally, there are some doubts on both sides that the emerging candidates will represent their party’s views or Americans overall.
You know what they say: "Attention is currency in the marketplace of ideas" - and everyone's attention is mostly going to be on only one of the candidates.

Donald Trump has scored a victory in his fight against challenges to his eligibility to run for the White House again when Michigan's top court declined to hear a case seeking to disqualify him from the state's presidential primary ballot.
The Michigan Supreme Court said it would not hear an appeal from four voters in the state seeking to bar the former president from the February 27 Republican primary for his role in the January 6, 2021, attack on the US Capitol.
The voters argued that Mr Trump, the frontrunner for the 2024 Republican nomination, could not serve as president under a provision in the US Constitution that bars people from holding office if they engaged in "insurrection or rebellion" after swearing an oath to the United States.
"We are not persuaded that the questions presented should be reviewed by this Court," the justices said in a brief order.
Founding fathers clearly wanted insurrectionists blocked! Except the president and the vice president, even though the VP is a sort of senator who is on the list.
More than a dozen states, including Colorado, are scheduled to hold primaries March 5 — Super Tuesday.
To date, no other court has sided with those who have filed dozens of lawsuits to disqualify Trump under Section 3, nor has any election official been willing to remove him from the ballot unilaterally without a court order.
The Colorado case was considered the one with the greatest chance of
success, however, because it was filed by a Washington D.C.-based liberal group with ample legal resources. All seven of the Colorado high court justices were appointed by Democrats.
However, the unprecedented constitutional questions in the case haven't split on neatly partisan lines. Several prominent conservative legal theorists are among the most vocal advocates of disqualifying Trump under Section 3. They argue the plain meaning of the constitutional language bars him from running again, just as clearly as if he didn't meet the document's minimum age of 35 for the presidency.
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.

The challenge to Trump’s eligibility propels Bellows into the spotlight in an unusual way. Many of her secretary of state colleagues across the country have
similarly been pressured to kick Trump off the ballot, but they’ve argued that the courts — not election officials — are the proper jurisdiction to make that call.
But Maine state law effectively has Bellows serve in a quasi-judicial role for eligibility challenges that many of her colleagues do not.
In a statement, Trump campaign spokesperson Steven Cheung attacked Bellows as “a former ACLU attorney, a virulent leftist and a hyper-partisan Biden-supporting Democrat.”He said the campaign “will quickly file a legal objection in state court to prevent this atrocious decision in Maine from taking effect.”

Apparently on the Apprentice, Trump got pissed off because one of his cue cards had the word “arbitrage” and he screamed that the script people were trying to sabotage him. He got so upset that he “soiled” himself and they had to stop filming the episode until he got cleaned up. His “body man” Keith Schiller, was responsible for cleaning him up, changing his Huggies and getting out the extra large squeegee. After the cleanup, they resumed with the episode. Also, the set was said to have a noticeable strong odor following the incident.
