We have different ideas of "common sense" then. To me, "common sense" is to look before proceeding at an intersection. We don't have it, so they put up stop signs to reduce the number of high-speed accidents. Reduce.

Being offensive gradually grows into harassment. There is no dividing line, with offensive on one side, and harassment on the other. In the end, someone has to decide in each case.

Until you can show me someone who can clearly and accurately point out where the distinction exists then there is no way for the law to be enforced. Judicial discretion is not the same as an arbitrary decision. If you can not draw a base line you can not charge someone with a criminal offence or you're left with retroactive law which is a gross miscarriage of justice.
