Later Wednesday night, after prayers were said, Bible verses read and gospel music sung -- and no shortage of expletive-laden rants directed at the federal government -- the occupants of the refuge signaled that they planned to surrender to the FBI in the morning.

The vowed to walk out without their guns but carrying American flags.


The passive aggressive one more night stand requires both pastor and gun toting Nevada politician:
The occupiers rejected the demands for hours before one of them said they will turn themselves in at a checkpoint once a national religious figure and a Nevada state legislator arrive. It was scheduled for 8 a.m. Thursday, but it wasn't clear if the deal involved all of the four occupiers.

Ranchers not interested in Bundy occupation, ever. They would like the land sure. Some sort of longer term contracts?
WHAT DID BUNDY ACCOMPLISH?

Bundy called for ranchers to renounce federal grazing permits at a well-publicized event on Jan. 23 at the refuge, but only one rancher from New Mexico took part in the event. The Hammonds distanced themselves from the armed occupation, and local Harney County leaders, particularly Sheriff Dave Ward and Harney County Judge Steve Grasty, voiced strong opposition to the occupation. Bundy and other group leaders were on their to a community meeting Jan. 26 north of the refuge when authorities set up a road block and arrested Ammon Bundy, his brother Ryan Bundy and others. Robert "LaVoy" Finicum, the group's spokesman, was killed in a confrontation with the FBI and Oregon State Police on the remote road.

The FBI released the following statement as the last four people left the occupied Malheur National Wildlife Refuge outside Burns in eastern Oregon:

At approximately 9:40 am on Thursday, February 11, 2016, the FBI brought three of the remaining Malheur National Wildlife Refuge occupiers into custody without incident. At approximately 11:00 am, agents brought the fourth into custody without incident.

* Sean Larry Anderson, age 47, of Riggins, Idaho
* Sandra Lynn Anderson, age 48, of Riggins, Idaho
* Jeff Wayne Banta, age 46, of Yerington, Nevada
* David Lee Fry, age 27, of Blanchester, Ohio

No one was injured, and no shots were fired. Thursday marks day 41 of the occupation of the refuge.

Agents arrested the remaining four occupiers as they walked out of the refuge to the FBI checkpoint. Those arrested will face arraignment before a U.S. Magistrate Judge in Portland on Friday, February 12, 2016.

At times, there were dozens of highly armed militants occupying, visiting and supplying the refuge. On Wednesday, February 3, 2016, a federal grand jury indicted 16 people:

* Sandra Lynn Anderson, age 48, of Riggins, Idaho

* Joseph Donald O'Shaughnessy, age 45, of Cottonwood, Arizona
* Jason S. Patrick, age 43, of Bonaire, Georgia
* Ryan Waylen Payne, age 32, of Anaconda, Montana
* Jon Eric Ritzheimer, age 32, Peoria, Arizona
* Peter Santilli, age 50, of Cincinnati, Ohio

Each subject faces one federal felony count of conspiracy to impede officers of the United States from discharging their official duties through the use of force, intimidation, or threats, in violation of Title 18, United States Code, Section 372.
All defendants are presumed innocent until proven guilty.

Even though it's ended peacefully, I think it was a mistake to go softly-softly.
It will just encourage the next standoff.
Like Bundy's original debacle. If you let them win, they will do it again.
Any protest involving arms should get the full treatment.

You didn't get many copycats after Waco.
While there is a market for shit, there will be assholes to supply it.

"Defendant Ammon Bundy intends to provide evidence to the Court to prove lack of jurisdiction over the refuge property due to issues with title which are in conflict with the United States Constitution. Given the complexities of the evidence involved, it is not a simple legal argument that can be briefed and expedited for the Court,'' Casey wrote. "Evidence must be taken, and witnesses will likely need to be called.
In response to the Bundy motion, Jennifer Rokala, executive director of the Center for Western Priorities, said the federal prosecution will help remind everyone of a 1935 U.S. Supreme Court case that left no doubt the eastern Oregon bird sanctuary is under federal control. The Center for Western Priorities is a nonpartisan conservation advocacy group.
"We look forward to Ammon Bundy's attempt to re-litigate 200 years of jurisprudence regarding the property clause, and the 1935 Supreme Court case that specifically established the American people's ownership of the Malheur National Wildlife Refuge,'' Rokala said in a prepared statement.

"At a time when groups like the American Lands Council are encouraging states to ignore centuries of property law, the Bundy case is the perfect opportunity to remind anyone who would try to take land from the American people that such efforts are wildly unpopular, unwise, and unlikely to succeed."
She points to a ruling by the nation's highest court in 1935, which found that the federal government has an incontrovertible claim to the refuge's wetlands and lakebeds, dating back to the 1840s, when Oregon was still a territory.
"Before Oregon was admitted to statehood, the United States is shown to have acquired title which it has never in terms conveyed away," Justice Harlan Stone wrote in 1935.
United States v. Oregon was the original suit brought by the United States against the State of Oregon to quiet title to 81,786 acres of unsurveyed lands in Harney County. By an executive order on Aug. 18, 1908, all of the land claimed by the United States in this suit was set apart as a bird reserve, known as the Lake Malheur Reservation, and administered as such by the United States Bureau of Biological Survey, under the direction of the Department of Agriculture.
In 1935, the U.S. Supreme Court ruled that the laws of the United States alone control the disposition of title to its lands. The states are powerless to place "any limitation or restriction on that control.''
The decision rested on whether the waters of the Malheur refuge were "navigable" at the time Oregon became a state. That's because, under the acts of Congress that admitted new states to the union, ownership of navigable waterways was automatically conveyed to the state.
Hundreds of people testified and numerous water and land measurement records were examined before the court concluded that, no, boats had never routinely plied the waters of the refuge for commerce, or any other purpose.
But Bundy's lawyers plan to challenge the ruling.
In Casey's motion, she wrote "..the land that is now the Malheur National Wildlife Refuge was not always 'federal land.' The federal government relinquished that land when it was previously deeded and homesteaded, thus relinquishing jurisdiction. It was mainly through property acquisition from the original deed holders that created this vast area now considered the wildlife refuge.''
She asked the court for more time to prepare a formal motion to dismiss the indictments based on lack of federal jurisdiction.
"Given the age of some of the documents and chain of title over the years, Defendant intends to call witnesses, as was needed in United States v. Oregon, 295 U.S. 1 (1935),'' Casey wrote.

Cliven Bundy's Lawyer Wanted The Koch Brothers To Pay Defense Fees
A public records request from Oregon Public Broadcasting reveals that Nevada Rancher Cliven Bundy's defense lawyer tried to get the Koch brothers to help cover Bundy's legal bills.

According to the e-mail obtained by OPB, Bundy's lawyer Joel Hansen reached out to Republican Utah state Rep. Ken Ivory, a mover and shaker in the transferring federal lands movement. Ivory sponsored legislation that became law in 2012, which transferred Utah fed lands back to the state although the lands still remain in federal control today. Hansen asked if Ivory might be able to reach out to the Koch brothers and see if they would be interested in helping pay for Bundy's legal defense.

"I cannot represent Cliven for free. I'm not independently wealthy," Hansen wrote in the e-mail to Ivory. "I understand from news articles that the Koch brothers are helping to fund Cliven's efforts to return our lands to the states. I would like to speak with someone about helping to fund the legal fees associated with this case."

Hansen is a Nevada-based lawyer who says he has been friends with Bundy for years and has worked in the state for 38 years. He's been active in land disputes with the federal government before, defending Cliff Gardner, another Nevada rancher who went head to head with the feds over grazing his cattle.

Hansen went on to say that the case would "be huge" and that the "legal fees will not be insignificant" as there are to be 19 defendants.

Bundy currently faces charges from his 2014 armed ranch standoff in Nevada.

According to the tweet from OPB, the news outlet did not recover any response from Hansen's email. Ivory did not immediately respond to an request for comment from TPM.

Ammon Bundy is best known as a leading light of the American militia movement (a motley coalition of various different flavors of firearms enthusiasts who hate the federal government). He’s famous for getting into armed standoffs with federal agents and violently occupying bird sanctuaries.
