There is this issue in Canada, too, where a couple won the right to not have any sex noted on their child's birth certificate. Their reason is that the gender is not determined until the child is able to, if ever, choose their gender, and then can be male, female, other, non-binary, whatever.

I am puzzled by this, because we're often faced with finger wagging by some about how sex and gender are different. So, why would the indeterminacy of gender be something to worry about in terms of designating a sex. The child is biological male, or female, and gender is something else.

What I think the governments should do is add a small space to the forms. Sex ____ and then Gender ____. Allow people to change the gender bit anytime they want, and let them fill it in with whatever verbiage they like. Maybe it's Gender: X. After all that's really how it's described - you can be a Xi, Xir, Xim, Xam, Xum, or whatever - otherkin - spirit-baby - non-gender - genderfluid - non-binary - "all" - or whatever.

That would solve the problem.

I assume the concern is that while the "finger waggers" might distinguish between gender and biological sex, the state and most of society don't.

It's not "pending" because there are people who are not clearly male or female and while some of those want to identify as male or female, not all want to. There are simply people where both the "biological" sex and the social gender are neither male nor female.

That's something some people simply cannot accept because it speaks against the false idea that sex is a clearly defined property with only two values instead of a spectrum (which it actually is).

No. According to the UN 1.7% of people are born intersex. Small percentage, I suppose, but still adding up to 119 million individuals worldwide.

One news report had visualised this fact by noting that there are more intersexuals than gingers in Germany. As a ginger, knowing several other gingers, that certainly touches me.
