Just down. Clearly he was too stupid to think about the consequences of shooting the floor inside. In any event, one never, ever fires "warning shots." You see, in the view of the law, firing a warning shot is as much assault with a deadly weapon as shooting the individual is if you do not have legal justification to shoot the individual in the first place. And if you have legal justification to shoot someone then the last thing you should be doing is wasting ammunition, and most importantly time, firing warning shots. If you have legal justification to discharge your firearm at another human being then you should be trying as hard as possible to make sure the round enters their body in a critical area that will instantly render them incapable of continuing the activity that gave you legal authority to shoot.

It's a felony in most places to discharge a firearm, or even display one as a threat if the situation is not grave enough to justify actually shooting the assailant. Annoying house guests do not in and of themselves pose an imminent threat of death or serious bodily harm, and even if you demand they leave and they don't, the fact (at least in Colorado) that you invited them in prevents you from asserting your right to use deadly force against an intruder because the law specifically requires that the initial entry to the residence must be "unwanted" and that the intruder must have an intent to commit a crime OTHER THAN the unwanted entry (like burglary or assault) therein, and the homeowner must reasonably believe that the intruder is using or about to use ANY degree of physical force, no matter how slight, against any occupant of the residence before he can kill the intruder.

Thus, in this case, the Castle Doctrine law would not apply even if the now-unwanted guests became violent. In such a case the violence would have to be such that it raises a reasonable belief that the homeowner's or another person's life is in imminent danger of death or serious bodily harm and that a lesser degree of force would be inadequate to prevent the harm before deadly force would be authorized.

Like I said, consult the law or an attorney before you decide to use physical force against anyone so that you know when and where and how it's legal to do so.
