Interesting... Here, Appeals courts judge the facts of the case all over again and are liable to pay little attention to the Appellant's wishes if they find something else they do not like.

Here in Scotland, there's a "not proven" verdict available, which sounds like what the judge was trying to say there.

Justice doest work that way and a problem with the adversarial system is if a woman accuses someone of rape and the accused is found not guilty in practical terms the courts are saying the rape didn't take place and the woman is lying.
With innocent until proven guilty a rape victim is considered to be lying until she can prove otherwise, no getting away from that

It sounded to me like he was trying to comfort the victim, basically saying that yes, you were abused, but due to legal technicalities we can't find the bastard guilty...Thinking Aloud wrote:Here in Scotland, there's a "not proven" verdict available, which sounds like what the judge was trying to say there.

This is the most unappealing thread on Ratz. Except for the "Gentlemen, get yer kits off!" thread, of course.

An ex-member of this forum appeared in court, charged with sexually abusing his nephew several decades previously. The case was thrown out due to the risk of an unsafe verdict.

It sounds like they want to protect the child. Perhaps if found not guilty it is more difficult to provide assistance to the child e.g. supervised visits only etc.
The latest fad is a poverty social. Every woman must wear calico,
and every man his old clothes. In addition each is fined 25 cents if
he or she does not have a patch on his or her clothing. If these
parties become a regular thing, says an exchange, won't there be
a good chance for newspaper men to shine?

Okay, so a verdict that would be detrimental to the child's welfare. kSean Hayden wrote:It sounds like they want to protect the child. Perhaps if found not guilty it is more difficult to provide assistance to the child e.g. supervised visits only etc.

So he was not guilty. Innocent.Pappa wrote:An ex-member of this forum appeared in court, charged with sexually abusing his nephew several decades previously. The case was thrown out due to the risk of an unsafe verdict.
Is he a voluntary ex-member? If not then according to the letter of the law he should be reinstated.

The departure was caused by other events, not the court case.devogue wrote:So he was not guilty. Innocent.Pappa wrote:An ex-member of this forum appeared in court, charged with sexually abusing his nephew several decades previously. The case was thrown out due to the risk of an unsafe verdict.

In these kinds of cases the only evidence is usually witness testimony of event that occurred many years ago. The verdict would be considered unsafe because it would rely on believing either the witness' testimony or the defendant's testimony. Any of the testimonies could be fabricated or faulty (due to the passage of time).Gawdzilla Sama wrote:WTF is an "unsafe verdict"?Pappa wrote:An ex-member of this forum appeared in court, charged with sexually abusing his nephew several decades previously.
