Actually there is such a thing as common sense.
It's the kind of thing that lead people to believe the universe has a designer.
Assumption without evidence because it 'seems' reasonable, but it completely ignores any and all evidence.

It's illegal to make offensive or threatening phone calls, or send similar letters. It hasn't led to overbearing censorship of that kind of communication.
Common sense dictates how far people can go, before they need a legal slap.
I can't see any reason why the same principles can't work well on the net. Common sense should prevail. Someone like this guy should pay for going too far, and taking pleasure in causing distress. We shouldn't make them immune, just in case of the danger that censorship would gradually creep in.
You just make sure that it's restriced to the worst cases. We make it work all the time, perfectly well. It's not rocket science.

Common sense is at the heart of our legal system. That's what a jury is there to supply. They listen to the evidence, and legal arguments, and then apply common sense. (hopefully).
And the police and prosecutors work on the same principle. They have to guess what a jury would do, when deciding whether or not to prosecute.
If a harassment or privacy law is being abused in some way, it needs amending. That's all. You don't scrap a car because it's got a damaged tyre. That's common sense.

Common sense is not the heart of a legal system. The heart of a legal system is rational deducation based on the evidence provided, with the individual - or mitigating - circumstances of the case taken in to consideration. Nothing 'common' about it.
