'D.C. Appeals Court Rules Trump Can Be Sued for Inciting Jan. 6 Attack'

On Dec. 1, a three judge panel for the D.C. Circuit ruled in Blassingame v. Trump that former President Donald Trump can be sued for civil damages for inciting the Jan. 6 attack on the U.S. Capitol. The court ruled that Trump is not protected by presidential “absolute immunity from civil damages claims predicated on his official acts” as established in Nixon v. Fitzgerald.

According to the panel, Trump cannot enjoy this immunity because his actions as alleged by the plaintiffs leading up to and on Jan. 6, 2021—including conspiring with allies to “obtain a second term despite his defeat in the 2020”—were not part of his official presidential duties, and therefore are not protected under absolute immunity.

Writing for the court, Chief Judge Sri Srinivasan asserted that, “When a first-term President opts to seek a second term, his campaign to win re-election is not an official presidential act.”

Former President Donald Trump's previous senior advisor, Stephen Miller, is not happy about Judge Chutkan's recent immunity ruling.

Chutkan, tasked with overseeing the criminal prosecution of Trump for alleged election subversion in the lead-up to the Capitol riot on Jan. 6, 2021, ruled on Friday that the former president is not immune from criminal charges just because he was president when the purported conduct occurred.

That decision didn't sit well with Miller, who took to social media to vent about the consequences.

"Many likely don’t appreciate just how radical and dangerous it is to revoke the doctrine of presidential immunity. In effect, this gives any single far-left judge, jury or prosecutor a veto over the actions of the democratically-elected president," Miller wrote. "It means a Letitia James or a James Comey alone decides what a president can or cannot do in the fulfillment of his duties. The fact that such a persecution may initiate after a president has left office is irrelevant: future presidents will now exercise their office within the narrow confines of this anti-constitutional anti-democratic framework."

Chutkan's ruling doesn't 'revoke the doctrine of presidential immunity.' She very clearly stated that a president engaged in attempting to overturn an election he's lost is not acting in official capacity nor fulfilling the responsibilities of the office. She added some cutting commentary regarding the fact that a former president is not bestowed with the 'divine right of kings to evade the criminal accountability that governs his fellow citizens.' Despicable autocratic shitbirds like Miller believe otherwise, at least in regard to Trump.

Miller goes on to invoke the Trumpist lie that the election was stolen--prosecuting Trump for attempting to overturn the election is nothing but a political act--Trump is merely 'exposing' the putative stolen election and 'seeking appropriate legal redress.' Miller is apparently talking about Trump telling an election official to manufacture votes, inciting a crowd to attack the Capitol, etc. because we know Trump lost dozens of cases where he actually sought 'legal redress' and he isn't being prosecuted for pursuing those cases.

Ziegler is obviously an intelligent guy and has done his homework, spending months going over the data and compiling and classifying the content. He makes the point that there is clear evidence of multiple crimes, none of which have been prosecuted. The reason? The laptop data “Implicates people of both parties….It’s really the uniparty that is implicated in this.” A bit later, “The intel agencies are the epicenter of the US uniparty.”

The interview is okay. Zeigler is careful in his answers, and there aren't any smoking gun revelations. When he says "that's a good question," he tends to give an answer you can read more into than what he said.

The most interesting thing about his trove is that you can download each document with its metadata, and verify its authenticity yourself. In short, do your own research because he doesn't have the staff to do it.
