The trials using humans went through validation by an ethics tribunal before being allowed. And it was allowed because the amount of nox used was below allowed legal limits and actually similar to what actual people working in traffic are exposed to regularly.
The human trials were fine, and allowed in Germany, mainly because they weren't even really trials because they were essentially the same as breathing the air people regularly breathe. That way, the test subjects can be compared to the control group, both of which breathe essentially the same air, and we can see which group has better or worse results.
