South Africa. A joke.
Re: South Africa. A joke.
According to news reports I read the sentence passed by the court of Appeals which is called "Murder" in South Africa has a broader meaning and includes what is called "Manslaughter" in other countries and that Pristorius' sentence must be compared with manslaughter sentences in other countries.

I think you have that wrong. Or you've been reading some pretty uninformed news reports. His first sentence was for culpable homicide, which is the general equivalent of manslaughter in other countries.NineBerry wrote:According to news reports I read the sentence passed by the court of Appeals which is called "Murder" in South Africa has a broader meaning and includes what is called "Manslaughter" in other countries and that Pristorius' sentence must be compared with manslaughter sentences in other countries.
The court of appeal overturned that with a conviction for murder.

https://en.wikipedia.org/wiki/Culpable_ ... uth_Africa"Culpable homicide" has been defined (in South African law) simply as "the unlawful negligent killing of a human being", the rough equivalent of involuntary manslaughter in Anglo-American law.[7]

Yes, that's what I said.NineBerry wrote:https://en.wikipedia.org/wiki/Culpable_ ... uth_Africa"Culpable homicide" has been defined (in South African law) simply as "the unlawful negligent killing of a human being", the rough equivalent of involuntary manslaughter in Anglo-American law.[7]
You seem to be completely confused about this.
He WAS originally convicted by the judge of culpable homicide which is the equivalent of manslaughter, and sentenced to five years.
The prosecution appealed the verdict, and the appeal court overturned the verdict, and convicted him of MURDER, which is the equivalent of murder.
The case was then sent back to the same original judge, for sentencing for the crime of murder, and she gave him six years, to replace the original five.
It's all there in the previous posts of this thread.

Re: South Africa. A joke.
No, it is the equivalent of "involuntary manslaughter", he was then convicted of voluntary manslaughter which in South Africa also carries the name "murder".

Call it what ever you will. He must have coughed a hell of a lot of money to get only 6 years.

I don't see any link for that. Perhaps you can't link to what flits out of your own head.NineBerry wrote:No, it is the equivalent of "involuntary manslaughter", he was then convicted of voluntary manslaughter which in South Africa also carries the name "murder".
But I'm waiting in keen anticipation for confirmation that he was convicted of voluntary manslaughter.
I posted this earlier. Here it is again as you can't be bothered to keep up:
No mention of it there.Wikipedia wrote: Re-sentencing[edit]
In December 2015, the Supreme Court of Appeals overturned the culpable homicide verdict and found Pistorius guilty of murder, believing Pistorius should have known that firing his gun would have killed whoever was behind the door, regardless of who he thought it was.[199] On 6 July 2016 Judge Thokozile Masipa sentenced Pistorius to six years in prison for murder, although the prosecution has called for 15 years, the minimum prison sentence in South Africa for murder.[199] Masipa argued that Pistorius had already served 12 months in prison for the culpable homicide conviction and was remorseful for his killing.[200]
In fact, the Judges' summary said the opposite of anything that could constitute voluntary manslaughter :
Wikipedia wrote: By a unanimous decision,[173] the court overturned Pistorius' culpable homicide conviction and found him guilty of murder in the death of Reeva Steenkamp. Judge Eric Leach read the summary of judgment. The panel of five judges found for the prosecutor's argument that Pistorius must have known that someone would die if he fired through the closed door into a small toilet cubicle. In the words of Judge Leach, "Although he may have been anxious, it is inconceivable that a rational person could have believed he was entitled to fire at this person with a heavy-calibre firearm, without taking even that most elementary precaution of firing a warning shot, which the accused said he elected not to fire as he thought the ricochet might harm him."[174]
