He is not a cop. He is someone who may or may not have some claim to the property he is on. You are on the street, say. He saw you as a threat.

The law as far as I am aware considers anyone aiming a gun at another person in a threatening way as a criminal and as such I think it still would be considered an act of reasonable self defence.
